A. Since after the death of your husband now you cannot apply or get marriage certificate after its registration under the Hindu Marriage Act, 1955 as a joint application along with individual affidavit of both the spouses is required for the purpose of the registration of the Hindu Marriage under section 8 of the Hindu Marriage Act, 1955 rather even for the purpose of the registration of the marriage even under any other central or local marriage registration Act a similar requirement is there. In your case your husband is no more to apply jointly with you for the registration of this marriage hence you have to use any other document such as a certificate issued by the priest who preformed your marriage or the temple where you got married,… [cont.]

Someone was married, got divorced, remarried but lied when signing marriage certificate. Is the marriage legal
Q. When someone gets married and asked whether or not they've been married prior to this up coming marriage by the lady/man at the registries (because you have to sign a legal document stating whether you were or not) upon signing the marriage certificate one of them lies and says they were not married prior to this new marriage-when in fact they were, is the couple married now legally married. Where can you go for help in proving that the information given was false or even to prove it so the innocent party is not having to pay for a divorce.

Q. This question is mainly for those who have already been through the process. Can someone please explain the process at the US Embassy for Certificate of Legal Capacity to Contract Marriage. Forms? Questions they may ask? Hours? Tips? My fiance' and I just really want a smooth IN & OUT experience at the Embassy. A. The embassy's web site explains everything in great detail... Certificate of Legal Capacity to Contract Marriage Any foreigner who wishes to marry in the Philippines is required by the Philippine Government to obtain from his/her Embassy a "Certificate of Legal Capacity to Contract Marriage" before filing an application for a marriage license. This certification affirms that there are no legal impediments to the foreigner marrying a Filipino (i.e, that the foreigner is already married to someone else). Unlike the Philippines, the U.S. Government does not keep a central statistical registry for births, marriages and deaths and cannot verify this information. Instead, the Philippine Government accepts an "Affidavit in Lieu of a… [cont.]

From where can I request a certified, legal copy of our mexican marriage certificate? We are both US citizens
Q. We have our original marriage certificate (acta de matrimonio), but we would like to obtain a couple copies of the document. Does anyone know of a website where we can request certified, legal copies?
Asked by rbassett007 - Tue Mar 4 15:34:13 2008 - - 1 Answers - 0 Comments

A. A certified copy of the marriage certificate (Acta de Matrimonio) prepared by the Registro Civil should be obtained from that office after the marriage has been performed. It is desirable to have the document authenticated by the Oficina de Legalizacion de Documentos, Palacio de Gobierno, Planta Baja, Guadalajara, Jalisco,Mexico. This service is performed for a nominal fee. While this does not of itself give validity to the marriage, it is proof for officials in the U.S. that the document is genuine (through the signature and seal of the Mexican official who signed it, and his authority to do so).

Is a marriage in TN valid if the name the woman used on the marriage certificate isn't her legal name?

A. you need a lawyer. If she lied about who she was when she got married then that is fraud and marriage can be invalidated. But honestly, she would have needed some really good fake ids and false documents to get married under a name that wasn't legally hers.

What is the argument for continuing to disallow legal marriage to adult gay couples?
Q. "Religous" beliefs aside (ie. God doesn't agree, the bible says, etc) , how is this justified? Keep in mind that hetero couples have the ability to legally marry regardless of their child producing/rearing plans. For further clarification: a spiritual union (ie. the commitment ceremony) and legal marriage ( submitting a marriage certificate to the courts, automatically obtaining property and tax benefits, etc) are 2 seperate events. I'm asking about the legal marriage. Ok,everyone, this talk of "where do we draw the line"? Comparing 2 consenting adults to say, a person marrying a dolphin, etc., I'm willing to bet is offensive to the gay community. You draw the line at 2 consenting adults. In addition, that dolphin marriage was not… [cont.]

A. In the UK we have recently started to accept civil partnerships, which I hope is the first step towards a better gay marriage law. The difficulty is that a lot of pople think that "marriage" can only be between a man and a woman and a lot of people think that gay people don't deserve the same human rights as straight people, I hope that these views fall out of favour because there is no real difference and surely two people in a happy, commited relationship are better off than two single people that are living alone and miserable!

Legal Name change (husband) - Marriage Certificate shows old surname - Ontario, Canada?
Q. My wife and I married in Cuba in 2006, afterwards I legally changed my surname (it was hyphenated - I removed the hyphen for my new family =)). My wife is having problems changing her surname on some of her ID because the marriage certificate still shows the old surname. We cannot get the marriage certificate amended (with my new surname) because we were married outside of Canada. Does anyone know of a legal document / weblink (in Ontario Canada) that states that it is legal to use an official "Name Change Certificate" as a supporting document to the marriage certificate so she (we) don't get these hassles when trying to update her Health Card, SIN card etc.

A. Depending on a visa you had when you came to USA, you may never have been able to adust status (apply for a green card). Did you have a C-1/D visa as an employee of a cruise ship? If so, you were NOT eligible for adjustment of status (green card). The only way was for you to go back to your home country and apply for a visa at the consulate. If your wife left/divorced you, you no longer have an option to obtain a green card through this marriage because it's up to her to petition for you. It appears that you have no legal status in USA, and I see no options to change or adjust status.

Marriage License has wrong name is it legal?
Q. I'm trying to find out if marriage license is legal. Wife did not use current legal name on marriage certificate. Here comes the sad part, the first time we supposedly got married, we weren't really married because she was still married to somebody else. So two years later she convinced him to "renew" their vows. Only thing is her name as it appears on the license is not the legal name she uses. We have child support court documents with a totally different name. Trying to find out if the "second" license is legal. Forget about the whole marriage under false pretenses. Any help would be appreciated.
Asked by jetsjoy - Sun Aug 24 19:35:20 2008 - - 4 Answers - 0 Comments

A. The question is "what is her current legal name"? She can't legally change her name through marriage when she is still married to someone else. The name on her license should be her previous name before she got legally married again. Her last name should be the same as yours now, but only since you got married legally. You should be fine. Just get the name changed on the child support documents to match.

Is a Muslim Marriage legal in Australia?
Q. My colleague is getting married to an Australian Convert in Singapore which will be registered with Registrar of Muslim Marriages. They are concerned if their Muslim Marriage Certificate is recognised in Australia. They are planning to get married again in Australia using a marriage celebrant if it is not. Any ideas if the Muslim Marriage Certificate is recognised in Australia? Especially if they decide to migrate there in the future? Appreciate your help!! She's my bestie!
Asked by eyantie83 - Thu May 14 03:26:40 2009 - - 1 Answers - 1 Comments

A. Yes it will be recognised but they need to advise the Australian Embassy and give them a copy of their marriage book. When they are married they will each be issued a book, the brown one is for the Husband and the green is for the wife. After that they can apply for a spouse visa to enter Australia which will be valid for 2 years. If they live in Aussie for 2 years straight the non resident can apply for residency.
